Employment Law Update (April 2009)
New rules on discipline and grievance handling now in
force
6th April saw the introduction of new rules on how
employers handle disciplinary matters and grievances in the
workplace.
The Statutory Dispute Resolution Procedures have now been
abolished (although there are complex exceptions for matters
already in progress on April 6th) and in its place
employers must now follow a new Code of Practice issued by ACAS,
the Advisory, Conciliation and Arbitration Service. Failure
to follow the Code is likely to result in any dismissal of an
employee being held to be unfair, with the additional possibility
of any compensation awarded to the employee being increased by up
to 25%.
