Employment Law Update (September 2009)
Vetting and Barring – are you confused yet?
The recent publicity in the media about the introduction of the
Vetting and Barring Scheme may have left you feeling confused about
what is happening and the reasons for it.
While media focus has been on the scheme's impact on volunteers,
it will have a big impact on employers and employees too. We
think the biggest impact is likely to be on employers who have not
previously had to perform pre-employment checks on their staff,
such as criminal records bureau (CRB) checks, as they will not be
familiar with the procedures. For employers who already
operate checks, the new rules add another layer of checks on top of
the ones they already do.
In addition, because the Scheme will cover a much wider section
of the workforce than the current CRB checks, many employers will
be taken unawares by the new rules, and could lay themselves open
to fines or at best face restrictions on the sort of work they can
take on if they are tradespeople or contractors who visit premises
where children or vulnerable adults are present
