Environmental Update (October 2009)

Packaging Regulation Fine

A Crawley based company, has been ordered to pay £23,406 after failing to comply with the Producer Responsibility Obligations (Packaging Waste) Regulations 2007 and for failing to produce evidence that it had recovered and recycled the obligated amount of packaging waste.
The Company operate as a manufacture, supply service and repair of electric catering and domestic appliances. The company had not registered with the Environment Agency (EA) and had not met its requirements to recover and recycle packaging between 1997 and 2008.

It was estimated that the company had avoided costs of around £16,000 by not registering and purchasing the correct amount of Packaging Recovery Notes. It was found to have been in contravention to the Producer Responsibility Obligations (Packaging Waste) Regulations.

The Company was fined £10,500, ordered to pay compensation of £9,906. The magistrates also ordered the company to pay £3,000 in costs to the EA.

The EA discovered the Company was not registered in May 2008 as part of routine checks.
