Employment Law Update (October 2009)

Vetting and Barring scheme goes live

The Government's new Vetting and Barring Scheme went "live" on 12th October. At the same time, the Government has also produced some guidance on how the scheme works in practice.

The Mentor Employment Law team has been looking at the Scheme and its implications for your business.

Businesses which already use Criminal Records Bureau Disclosure procedures:

  • These businesses can continue to operate as before, using existing forms and procedures, although they may find more job roles come within the scope of "regulated activities" requiring checks.

Businesses which don't vet their employees:

  • These businesses might find some job roles are affected by the new rules, although because of the phasing-in arrangements, checks may not be required on existing staff;
  • For new employees who are affected, the changes affect the whole recruitment procedure and you should take advice before proceeding.

How Mentor can help

  • Our Employment Law consultants will be discussing the impact of the Scheme on your business with you during the coming months.
  • If you have any queries in the meantime, please call the Telephone Advice service or see our website for further information.
