Employment Law FAQ

Refusal To Sign

What happens if an employee refuses to sign their Statement of Particulars of Employment?

Firstly you should discuss their concerns or queries about the statement with a view to gaining their acceptance and clarifying any misunderstandings. If he or she still refuse to sign it and don't raise specific objectives but carry on working, he or she will be deemed to have accepted the terms and conditions. However, it will be difficult to enforce clauses such as deductions from wages and shortterm working without signed agreement from the employee.
