The tribunal and appeals process

Representation
At the hearing you won’t be on your own. All of our litigators
are experienced advocates and will undertake the tribunal advocacy
on your behalf. This includes;
- Management of the witnesses and evidence
- Identifying & addressing preliminary issues
- Examining and cross-examining witnesses
- Preparing and delivering opening and closing submissions
Specialist Counsel
A particularly complex case may warrant the use of a specialist
barrister or advocate.
If you choose to instruct a barrister through us, you will
benefit from our preferential rates, as well as their skill and
expertise. Your litigator can discuss the need for a barrister with
you.
Changes in Circumstances
There may be case developments or further information may come
to light which alters your position. If this happens, we will
provide you with further advice and guidance. Certain action may be
required, including;
- Review of the merits of the case and re-consideration of case
strategy
- Amendment to the pleadings
- Negotiating settlement
Negotiated Settlement
Our job is to assist you to manage your risks, including legal
and financial risks plus risks to your reputation &
professional standing. When considering the option of settling your
claim you should bear in mind;
- The cost associated with taking people out of your business to
deal with this matter, which you will not be able to recover
- A tribunal is a public forum and judgments are in the public
domain

By negotiating settlement of a claim, you retain control over
the situation. Settlements often contain confidentiality clauses,
which prevent details becoming public knowledge. All settlements
are entered in to on a strict “no admission of liability”
basis.
At the end of a case / appeals
We will ensure that you are fully aware of the outcome and what
ramifications any settlement, decision or award has for your
business.
- We will advise you on whether there are any grounds upon which
you might appeal. It may also be the case that the Claimant appeals
a decision that has gone in your favour
- If you choose to pursue an appeal or need to defend an appeal
against you then we can assist you with that too. We would be
pleased to discuss your options in this regard as and when
appropriate
