What happens before tribunal?
Our first priority, once instructed by you, is to appoint a
litigator to deal with the case within three days of us receiving a
signed agreement from you. The key steps prior to a tribunal
are:
Initial provision of case advice
To give you a better understanding of the claim being made
against you, we can;
- Review the claim and relevant paperwork
- Identify the relevant facts which are in dispute and clarify
the legal issues involved
- Identify any preliminary issues which may warrant a pre-hearing
review
- Give you a preliminary assessment of the merits of the
complaint, including an indication of the potential value of any
award that may be made against you
Completion of a Response
Your litigator will work with you to prepare and draft your
response to the claim;
- All claims must be responded to within 28 days of the date on
the original tribunal papers, unless an extension of time is
granted by the tribunal
- Working to the deadline set by the employment tribunal, we will
draft your response, review it in consultation with you and submit
it for registration to the appropriate tribunal office on your
behalf
Case preparation
We will guide you through the various steps that may be
required. This may involve;
- Attending a case management discussion with the tribunal
- Compliance with any issued Orders
- Attending a pre-hearing review
- Gathering the relevant documentary evidence
- Applying for Orders in accordance with the employment tribunals
rules of procedure
Once all of the pertinent information has been identified, your
litigator will make an in depth analysis of the prospects of your
case.
Hearing Preparation
To ensure you are prepared for any case hearing we will;
- Identify the relevant documentary evidence
- Identify the relevant witnesses and produce a witness statement
for each of them
- Ensure compliance with all tribunal orders
- Make sure that you are clear on the role and responsibilities
of each person on the day
- Address any worries that you or any of your witnesses may have
prior to the hearing
